The Opportunity
A pivotal role, the Assistant General Counsel, Patent Litigation is responsible for actively developing and executing patent litigation strategy across a broad and diverse international IP and product/technology portfolio.
With a primary focus on US and European patent litigation, you will proactively set and drive high-stakes litigation strategy including leading and supervising external counsel while working within a global matrixed structure to input into global patent disputes and strategies. This role is equally responsible for avoiding litigation and other disputes, through preventative and pragmatic legal advice, identification of potential risk areas, and driving early resolution of disputes/claims when necessary.
Reporting directly to the VP IP, Head of Patent Litigation, this role offers unparalleled exposure to enterprise-level decision-making and the opportunity to operate as a trusted strategic partner within a pioneering globally integrated pharmaceutical powerhouse. The role will entail the individual quickly establishing visibility with senior stakeholders and facilitating a smooth elevation in both scope and responsibility.
Key Responsibilities
- Lead highly complex and significantly impactful patent enforcement initiatives.
- Develop and execute litigation strategy across various jurisdictions, with a focus on the US and Europe.
- Work very closely with external counsel and internal stakeholders to develop and drive overall litigation strategy, including worldwide litigation strategies, ensure compliance with company policies, and drive cost savings.
- Represent GSK at meetings, hearings, and trials.
- Effectively manage numerous competing priorities and perform at a high level in a continually changing global legal, regulatory, and scientific environment, including providing input and strategy into foreign proceedings, such as the EPO, UK, German and UPC proceedings.
- Interface with company at all levels, including the General Counsel and other senior business and legal employees.
- Demonstrate capacity for innovation in providing unique and creative solutions to complex legal issues.
- Drive AI solutions to deliver AI initiatives, including those related to litigation management and outcomes.
- Communicate effectively and build teamwork among company employees involved in enforcement and defense of critical GSK IP, including driving key learnings back into the department.
The Candidate
- Qualified US Attorney; JD required.
- 12+ years of significant experience with complex patent litigation in the biotechnology and/ or pharmaceutical industries.
- Major US law firm and/or large corporate litigation department experience.
- Demonstrated experience with leading international IP pharmaceutical litigation cases.
- Possess a proven track record of high stakes court room advocacy.
Additionally, and preferred:
- Extensive hands-on experience with all aspects of US patent litigation, including fact and expert discovery (witness and report preparation), as well as in court experience from motion practice to bench and jury trials.
- An advanced scientific degree.
- Registered to practice before the USPTO.
- Ability to work in a highly team-oriented environment.
- Creative and strategic approach to the development and enforcement of IP.
- Ability to communicate competently and confidently with senior management.
